1. Company Information

Cagle Landscape (“Company,” “we,” “our,” or “us”) provides custom landscape design, installation, maintenance, hardscapes, and irrigation services for residential, commercial, and HOA properties.

2. Services

Services may include, but are not limited to:

  • Custom landscape design and installation

  • General landscape maintenance

  • Hardscapes and outdoor construction

  • Irrigation installation, inspections, and adjustments

All services are subject to availability, site conditions, weather, and scheduling constraints.

3. Estimates & Proposals

  • Estimates are non-binding unless stated otherwise in writing.

  • Pricing is based on visible site conditions at the time of inspection.

  • Hidden or unforeseen conditions (including underground utilities, soil issues, drainage problems, or root systems) may result in additional charges.

  • Any changes requested after approval may require a written change order and additional fees.

4. Payments

  • Payment terms are outlined in your proposal, invoice, or agreement.

  • Deposits may be required before work begins.

  • Final payment is due upon completion unless otherwise stated in writing.

  • Late payments may result in service suspension, late fees, or collections.

  • All unpaid balances remain the responsibility of the client.

5. Cancellations & Rescheduling

  • Cancellations must be submitted in writing.

  • Deposits are non-refundable once materials are ordered or labor is scheduled.

  • Weather delays, supply delays, or unforeseen circumstances may require rescheduling without penalty to the Company

6. Weather & Force Majeure

Cagle Landscape is not responsible for delays or failure to perform caused by weather, natural disasters, labor shortages, supplier delays, government actions, or events beyond reasonable control.

7. Property Access & Conditions

  • Clients must provide safe and reasonable access to the property during scheduled service times.

  • Pets must be secured.

  • The Company is not responsible for damage caused by pre-existing conditions, undisclosed underground utilities, or obstacles not identified prior to service.

8. Plant & Material Disclaimer

  • Living materials (plants, sod, trees) are subject to environmental conditions beyond the Company’s control.

  • No guarantees are made regarding plant survival, appearance, or growth unless a written warranty is provided.

  • Damage caused by drought, pests, disease, improper watering, or acts of nature is not the responsibility of the Company.

9. Maintenance Services

Ongoing landscape maintenance services are governed by the Maintenance Contract Addendum, which is incorporated by reference into these Terms and Conditions.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Cagle Landscape is not liable for indirect, incidental, or consequential damages.

  • Total liability shall not exceed the amount paid for the specific service giving rise to the claim.

  • Clients agree to indemnify and hold harmless the Company from claims arising from third-party actions, undisclosed conditions, or misuse of services.

11. Website Use

  • Website content is provided “as is” without warranties of any kind.

  • We do not guarantee accuracy, availability, or uninterrupted access.

  • Unauthorized copying, scraping, or use of website content is prohibited.

12. Intellectual Property

All content, images, logos, designs, and branding on this website are the property of Cagle Landscape and may not be used without written permission.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

14. Modifications

Cagle Landscape reserves the right to update these Terms and Conditions at any time. Continued use of the website or services constitutes acceptance of any revisions.
